RunComps Terms of Use (Pilot Program)

1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the RunComps real estate comparison service, which is currently offered as a private pilot program (“Service”). By accessing or using the Service (including by logging in via Google OAuth), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not access or use the Service.

2. Eligibility (Invitation-Only Access)

Invite-Only: The Service is in a private, invitation-only testing phase. You may use the Service only if you have been specifically invited by RunComps and given access through a designated Gmail account. You agree not to share your invitation or access credentials with anyone who was not separately authorized by RunComps.

Age and Authority: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. If you use the Service on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms, and “you” as used in these Terms includes both you and that entity.

3. Permitted Use and Prohibited Conduct

We grant you a limited, non-transferable, non-exclusive, revocable license to access and use the Service solely for your personal evaluation and testing purposes during this pilot program. You agree that you will not:

• Copy, reproduce, distribute, publish, screenshot, or share any part of the Service or its content without RunComps's prior written consent.
• Reverse-engineer, decompile, disassemble, or attempt to discover the source code or algorithms of the Service.
• Use any data or output from the Service to create a competing product or for commercial purposes beyond internal evaluation.
• Attempt to gain unauthorized access to the Service or its systems, or impersonate any person or entity.
• Use automated means (e.g., robots, scrapers) to extract data outside the intended interface.
• Use the Service in any unlawful, harmful, or fraudulent manner, or input malicious content.
• Interfere with or disrupt the Service's functionality.

Any breach of these restrictions may result in immediate termination of your access and could violate applicable law.

4. Account Responsibilities

You are responsible for:

• Providing accurate information and not misrepresenting your identity.
• Keeping your Google account and credentials confidential and not sharing them.
• Notifying RunComps immediately of any unauthorized use or security issues.
• Ensuring your own equipment and internet access are compatible with the Service.

5. Fees and Payment

The Service is currently free during the pilot program. RunComps may introduce fees in the future with advance notice. Continued use after fees are implemented constitutes agreement to pay. If you disagree, you may stop using the Service.

6. Suspension and Termination

You may stop using the Service at any time. RunComps may suspend or terminate your access with or without cause, especially for violations of these Terms. Upon termination, your rights cease, and you must destroy any retained materials if requested.

7. Confidentiality

You may access Confidential Information (e.g., features, data, performance) during the pilot. You must use it only for testing, not disclose it, and protect it with reasonable care. These obligations persist indefinitely unless released by RunComps.

8. Feedback

Any feedback you provide may be used by RunComps without restriction or compensation. Feedback is not confidential, and RunComps is not obligated to implement it.

9. Intellectual Property

The Service and its content are owned by RunComps and its licensors. You receive a limited license for pilot use only. Third-party data remains their property and may not be reused outside the Service.

10. Privacy

RunComps collects minimal data (e.g., Gmail login info, search queries) for authentication and functionality. No third-party tracking is used. See the Privacy Policy for details.

11. Indemnification

You agree to indemnify RunComps against claims arising from your misuse of the Service or violation of these Terms or laws.

12. Disclaimer of Warranties

The Service is provided “AS IS” with no warranties. RunComps does not guarantee accuracy, availability, or suitability. Use is at your own risk.

13. Limitation of Liability

RunComps is not liable for indirect damages or losses. Total liability is capped at $100 or fees paid in the last 6 months, whichever is greater.

14. Pilot Program Conditions

The Service is pre-release and may change or end at any time. Features, data, and availability are not guaranteed, and no formal support is provided.

15. Updates to Terms

RunComps may update these Terms with notice. Continued use after changes indicates acceptance.

16. Governing Law

These Terms are governed by California law, with disputes resolved in Los Angeles County courts.

17. Miscellaneous

These Terms are the entire agreement. Invalid provisions are severed, and rights cannot be assigned without consent.
